Although there are hundreds of federal and state statutes containing fee-shifting provisions, considerable confusion continues to exist among practitioners about the mechanics of a fee petition. This should not come as a surprise. Few cases today are litigated to judgment, and only a small percentage of those judgments involve fee-shifting provisions. The result is that even lawyers with substantial experience in fee-shifting litigation rarely get the chance to prepare—or defend—a fee petition. This seminar aims to fill that gap.

ABOUT THE SPEAKERS
David L. Greenspan, McGuireWoods LLP / Tysons
David Greenspan is a trial lawyer whose practice focuses on proactive counseling and aggressive litigation of employee mobility disputes and complex employment matters. He works with his clients to identify and resolve issues before they become adversarial in nature. He also serves his clients as a zealous advocate in litigation, arbitration and other administrative proceedings.
Mr. Greenspan is an experienced litigator with first-chair trial experience. He regularly represents employers in state and federal courts and administrative agencies throughout the country. He has also litigated many employee mobility cases. On the plaintiff side, he has obtained injunctions that prohibited people from competing against firm clients. On the defense side, he has effectively represented employers who have hired employees with non-compete or confidentiality agreements.
Mr. Greenspan regularly counsels corporate clients on a wide range of labor and employment topics including the protection of corporate assets through the use of employee agreements and corporate policies, wage and hour matters, compliance with Title VII, the ADA, the FMLA, the WARN Act, and USERRA. Mr. Greenspan has also developed an area of interest in executive employment agreements. In this regard, he has worked with CEOs in various industries, former corporate general counsel, prominent elected federal officials no longer in office, and one Hall of Fame NBA coach.
Mr. Greenspan is a well-regarded public speaker who has conducted myriad presentations and training seminars throughout the country as a presenter for private employers, municipalities, educational academies, and trade associations. He regularly speaks on topics including: protection of corporate assets; prevention of illegal discrimination, harassment and retaliation in the workplace; the complexities and intersection of the ADA, FMLA, and related state laws; and general management relations topics.
Mr. Greenspan serves as the Tysons Office Pro Bono Partner and is an active member of Firms in Service, a consortium of local firms and corporate legal departments dedicated to improvising the quality and quantity of pro bono services in the Northern Virginia area. He is on the Board of Directors for Legal Services of Northern Virginia and recently was selected to serve as a Co-Chair of the Virginia Bar Association’s Pro Bono Counsel. Mr. Greenspan also recently accepted a three-year appointment to serve as faculty member for the Virginia State Bar Harry L. Carrico Professionalism Course.
Zachary A. Kitts, K&G Law Group / Fairfax
Zachary Kitts is a partner at K&G Law Group, PLLC, where he concentrates his practice in the areas of qui tam litigation, employment law, business torts, and other complex civil litigation matters.
Mr. Kitts has prosecuted a wide variety of False Claims Act/qui tam claims in state and federal courts across the country against health care providers, defense contractors, financial institutions, and others. To date, his cases have returned more than $117 million to the public fisc and have resulted in a number of precedent-setting opinions. He is widely recognized as an expert on fee-shifting litigation and has served as an expert witness in fee disputes as well as in legal malpractice matters that turn on the duties owed by counsel when one party will bear the other party’s fees and costs.
Mr. Kitts is a member of the Virginia State Bar’s standing committee on professionalism and is a member of the Virginia Bar’s Mandatory Professionalism Course faculty; from 2013 to 2019 he served on the Virginia Bar’s Mandatory Continuing Legal Education Board. He has been included in the Virginia and D.C. editions of Super Lawyers magazine every year since 2011 and has been included in Best Lawyers in America every year since 2015; in 2020 he was named Qui Tam Lawyer of the year by Best Lawyers in America. He received his B.A. from George Mason University in 1998 and his J.D. from American University’s Washington College of Law in 2001.
