Equitable Remedies in Real Estate Litigation Cases

Real estate litigation often involves claims for equitable remedies, including claims for declaratory relief, quiet title, partition, specific performance, and injunctive relief. However, the special rules applicable to these claims can create traps for the unwary. It is essential that the real estate practitioner understands when equitable relief is available, as well as some of the common defenses to such claims. This session discusses many of the issues that arise when equitable relief is sought, including: the inapplicability of the statute of limitations to equitable relief, additional legal relief available under the clean-up doctrine, equitable defenses, and the causes of action for which such relief is commonly available.

Risky Business: Strategies for Assessing and Managing Environmental Risk in Commercial Real Estate Transactions

The objective of this presentation is to provide a framework for Virginia attorneys in Virginia to understand, assess, and manage environmental risk in the context of handling commercial real estate transactions. Following a brief summary of the development of federal environmental laws and state environmental regulatory programs, we discuss the types and categories of environmental risk at a conceptual level, and then discuss certain tools and strategies for assessing and managing environmental risk available to Virginia attorneys.
Zero Trust Architecture: An Ethical Imperative for Lawyers

Many lawyers still look at us blankly when we talk about zero trust architecture (ZTA). If you don’t understand what ZTA is, this CLE is for you. For years, law firms relied on securing their perimeter, but that model of cybersecurity has become obsolete. Now our data is often outside law firm networks—often in a number of cloud services—and on the personal devices of attorneys and staff who work from home. We cannot protect that which is outside our networks.
The federal government projects that it will have fully adopted ZTA by the end of 2024. In a way, the government is setting a standard for “reasonable cybersecurity” that will apply to all businesses, including law firms. And no, you can’t simply buy ZTA as a product—it really is an architecture. Our experienced speakers make ZTA understandable in this session. Law firms must adopt ZTA’s “Never Trust, Always Verify” framework—sooner rather than later.
Land Use & Zoning: What Every Transactional Lawyer Should Know

This presentation discusses how wire fraud through business email compromise is currently impacting real estate transactions. It provides insight into the Business Email Compromise (BEC) scheme, a brief discussion on the financial impact of this fraud scheme, examples of social engineering used by fraudsters to infiltrate transactions, including ways to recognize the fraud scheme. It also provides suggestions on how agents can help protect themselves and consumers from this fraud scheme.
