    It is improper for an attorney to represent the wife in a divorce action when the attorney's associate had gratuitously discussed the matter with the husband even though the husband had declined to retain the said associate. [See II: DR:5-105; see also I: Definition of the Practice of Law, under which an attorney-client relationship may be deemed to arise without regard to whether a fee has been paid by the client.]
