Trustee on a second deed of trust for the benefit of seller represented buyer in a real estate closing. Seller was not represented. When buyer defaulted on the second deed of trust, seller retained counsel who requested that he be substituted as trustee. The trustee should resign as requested. ( § 55-60 and § 26-49 Code of Virginia, as amended) [See II: DR:2-108(A)(3).]
