LEO: Divorce - Conflict of Interests LE Op. 355
Divorce - Conflict of Interests.
February 6, 1980
It would not be ethically permissible for an attorney to continue representing the ex-husband of wife in child custody proceedings where he acted as attorney for wife's current husband in matters relating to marital problems which could aid the ex-husband in his child custody proceedings, unless attorney obtains the express consent of wife's current husband. [See II: DR:5-105(D).]
