Personal Injury - Conflict of Interest.

An attorney retained by both the driver and a passenger in an automobile involved in an accident with a vehicle driven by the alleged tortfeasor may continue to represent the passenger after the settlement of the driver's claim even though the tortfeasor threatens to file a third party action against the driver, assuming that the passenger does not claim the driver was negligent in any way. [See II: DR:5-105(D).]
