    Attorney as Counsel for Buyer and Seller — Conflict of Interest.

    It is ethically improper for an attorney who undertakes to represent both buyer and seller in a residential real estate transaction to thereafter initiate suit on behalf of the buyer against the seller for damages or specific performance if the seller fails to consummate the sale. It is also ethically improper for any attorney associated with the settlement attorney to represent either buyer or seller. [See II: DR:5-105(A), (C) and (D); and DR:5-102(A).]
