LEO: Conflict of Interest - Real Estate LE Op. 424
Conflict of Interest - Real Estate.
August 14, 1981
It is not improper for an attorney to represent both the seller's real estate agent and the purchaser of property in a suit against the seller of the property for breach of contract. [But see DR:5-105 and DR:5-106.] Furthermore, if multiple employment is undertaken, the attorney should be mindful of the need to withdraw if the attorney's ability to represent each of his or her clients is in any way impaired.
