LEO: Conflict of Interests/Personal Injury LE Op. 566
Conflict of Interests/Personal Injury.
May 2, 1984
At the time of a two vehicle traffic accident, husband was operating a motor vehicle in which his wife was a passenger. It is not improper for an attorney to defend the husband/driver on a related traffic offense and subsequently to represent the wife in a personal injury action against her husband and the driver of the other vehicle, as long as the attorney has made full disclosure to and has obtained the informed consent of both husband and wife.
