Guardian Ad Litem - Appearance of Impropriety/Conflict of Interest.
September 14, 1984
It is not improper for an attorney to serve as guardian ad litem in a mental health commitment hearing when a superior/subordinate relationship exists between the attorney's wife/director of social work services and a social worker who testifies in the hearing about the ward, whether or not the ward who is the subject of the hearing is capable of giving informed consent.
