Conflict of Interest - City Attorney - Part-Time Private Practice.

As long as a part-time town or city attorney is representing private clients as an attorney engaged in the private practice of law, the part- time town or city attorney may represent his private clients in an action against an adverse party in an individual capacity even though the adverse party is an attorney and the mayor of the same town or city. However, the part-time town or city attorney may not represent any parties to a matter in which the mayor of the same town or city is an adverse party by virtue of the position the attorney occupies as mayor of the same town or city.
