Appearance of Impropriety - Private Representation by Commonwealth's Attorney.

It is not improper for a commonwealth's attorney to represent a private party in a child custody or a child support proceeding in said attorney's local juvenile and domestic relations general district court in the absence of any effort to use the public office for the private party's gain, or implication that the public office will or may influence the court's disposition of the proceeding; and provided that, as to both the parties and their witnesses, there are no pending criminal charges and no investigation known to said attorney.
