Conflict of Interest - Former Client-Prospective Client - Substantially Related Matter - Representation - Wrongful Death - Personal Injury.

Under the provisions of DR:5-105(B) of the Virginia Code of Professional Responsibility, a lawyer or law firm which has formerly represented and concluded settlement of claims of an estate for wrongful death, may represent another individual in a substantially related matter against a third party who precipitated the decedent's demise and whose conduct is the basis for the prospective client's claim.
