    Conflict of Interest — Preparation of Waivers and/or Answers in Domestic Relations Cases.

 

    February 20, 1985

 

    It is improper for an attorney in a divorce case to prepare pleadings--including either a waiver of notice or an answer--for both parties or for an unrepresented defendant.

 

    It is improper for said attorney knowingly to provide sample forms for such pleadings for the defendant which might be copied and used by the whether or not the divorce case is based upon the “no fault” ground and whether or not the issues of custody, support, equitable distribution or attorney's fees are in controversy.
