Commonwealth's Attorney - Part-Time Partner - Domestic Relations - Conflict of Interest.

The spouse of a disqualified assistant commonwealth's attorney may represent the former private client of his spouse provided that there is no nexus between the private matter for which the spouse is retained and the disqualified spouse's public responsibilities. The spouse cannot be disqualified vicariously from accepting representation simply because his wife cannot accept the representation. [ DR:5-105(E); cf. LE Op. 594, LE Op. 600, LE Op. 675]
