LEO: Continued Practice by Associate in Office, LE Op. 694
Continued Practice by Associate in Office of Suspended Partners.
May 10, 1985
It is improper for an associate to continue a firm's practice where the firm's partners no longer hold licenses to practice law. However, the associate may maintain an independent practice in such office and pay office expenses incident to the independent practice, provided all indicia of the previous firm are removed and the associate avoids even the appearance of association with the firm of the suspended partners. See Opinion 524. The associate may assume representation of his former employers' clients only if the clients are informed of the suspension and the fact they may seek whatever counsel they choose.
