LEO: Service of Process - Initiation of Civil LE Op. 722
Service of Process - Initiation of Civil Suit.
August 30, 1985
Assuming that such advice does not constitute a crime, it is not improper for an attorney to advise a client that the client has no duty to cooperate in the service of civil process upon him and that he may avoid such service of process by not personally answering his door or by taking vacation leave. The committee's function does not include rendering advice about the possible criminal consequences of such conduct.
