Conflict of Interest - Domestic Relations - Waiver of Rights Under Soldiers' and Sailors' Civil Relief Act.
January 13, 1986
It is not improper for plaintiff's counsel in a divorce case with a service person as defendant to prepare a "Waiver of Rights Under Soldiers' and Sailors' Civil Relief Act" so long as it is tendered to the defendant's legal officer in such a way that execution and return of the waiver cannot be accomplished without the legal officer's advice and guidance.
