Conflict of Interest - Attorney as Third Party Defendant.

It is not improper for an attorney to represent plaintiffs in a pending state action even though said attorney is a third party defendant in an action pending elsewhere, the subject of which is the alleged malpractice of the plaintiffs' predecessor counsel. The Committee advises that said attorney fully disclose to client the claims made against him by the former counsel.
