LEO: Real Estate - Attorney as Escheator - LE Op. 863
Real Estate - Attorney as Escheator - Position Adverse to Escheat Purchaser.
April 1, 1987
As attorney served as escheator. Subsequently, the attorney brought a suit to quiet title against the party who purchased the property subject to the escheat sale. There is a strong possibility that the attorney/escheator will be called as a witness. Under the circumstances, it is improper for the attorney to serve as counsel in the suit to quiet title.
