LEO: Attorney/Client — Withdrawal as Counsel — LE Op. 872
Attorney/Client — Withdrawal as Counsel — Missing Client.
February 2, 1987
An attorney undertook representation of a client who has since disappeared. Despite a diligent search, the client cannot be found and the statute of limitations is about to expire on the client's cause of action. Under the circumstances, it is not improper for the attorney to file suit to prevent a statute of limitations from running, and to contemporaneously file a motion to withdraw as counsel. [LE Op. 841]
