An ethical duty exists to provide a client with the basis or rate of a lawyer's fee, including the method of determining any contingency fee. [ DR:2-105(B) and (C)]
In a situation where the fee and cost breakdown might prejudice a companion case which is before a court, the Committee opines that it is in the best interests of the attorney to allow the court to decide whether the prejudice to the companion case outweighs the disclosure requirement to the former client. [ DR:4-101(B) and (D), DR:7-101(A)(3)]
