Gain a working understanding of Virginia’s simplified no-fault divorce requirements, which no longer require a corroborating witness, and then take a tour of digital asset issues to learn how they can complicate property division in divorce cases in the Commonwealth. Review the changes to section 20-106 and familiarize yourself with the one-party affidavit process in support of an uncontested divorce. Compare Virginia’s new procedure to those used in other states with a similar one-party process. A sample affidavit will be provided, and the benefits and potential issues of using this streamlined divorce process are also covered.
Undoubtedly, you have heard about digital assets, but what are they and how are attorneys and courts addressing them in divorce cases? This seminar provides a basic understanding of the various forms of digital assets, how they are acquired, sold, and traded, how they impact income for purposes of calculating support, how they are owned, and how they can be valued and divided in the context of equitable distribution of the marital estate. An understanding of digital assets is critical to any case where these are part of the marital property. Build your vocabulary for and understanding of the varying types of digital assets including relevant definitions and platforms.
The seminar focuses on the current purchasing power of digital assets, steps to acquire the currency and assets, the meaning of a digital wallet, how to identify, trace, convert, and transfer the assets, and any intellectual property rights that may attach. Explore how to find and value these digital assets and how to present evidence to the court for purposes of properly calculating support and properly valuing and dividing the marital estate.
Our experienced presenters also review evolving federal and state laws that affect these assets as well as reviewing current case law that addresses these assets and currencies in the context of a divorce action.

ABOUT THE SPEAKERS
Kyung (Kathryn) Dickerson, SmolenPlevy / Vienna
Kyung (Kathryn) Dickerson, a partner with Smolen Plevy, has received numerous awards throughout her career, including being recognized as one of the “Leaders in the Law” by Virginia Lawyers Weekly in 2007. She has a varied practice that includes domestic relations matters and civil, estate, and probate litigation and has appeared before the various Circuit and District courts throughout Northern Virginia and in the Federal, Superior, and Court of Appeals for the District of Columbia and a number of its administrative agencies. She has served the Virginia State Bar over the years, currently serving on its Bar Council and on the Board of Governors of its Diversity Conference. Ms. Dickerson was also appointed a Commissioner of the Judicial Inquiry and Review Commission in 2021. During her career, she has also served as President of the Virginia Women Attorneys Association, President of the Asian Pacific American Bar Association, and has been involved with the George Mason University School of Law, serving on its Diversity, Equality and Inclusion Taskforce and on its Alumni Association’s Board of Directors for a number of years and as its President (2010–2012).

Eva N. Juncker is a partner in Cipriani & Werner’s Washington metropolitan area (DMV) offices and Co-Chair of the firm’s DMV Family Law practice group. She focuses her practice on all areas of family law, including divorce, juvenile law, custody, support, equitable distribution, post-divorce modification, partition actions, transgender issues, prenuptial agreements, postnuptial agreements, marital settlement agreements, and property settlement agreements. She also served as a qualified guardian ad litem in Virginia for over 10 years.
Ms. Juncker’s experience as a qualified guardian ad litem enabled her to focus on the independent best interests of the child while also supporting her client’s objectives. Her strategic approach on cases focuses on the best method of dealing with family law matters to maximize the desired outcome for her clients. While dealing with family law matters can be difficult emotionally and legally, Ms. Juncker is adept at addressing all aspects of the case assuring her clients that she is involved every step of the way for their legal matters.
Prior to joining C&W, Ms. Juncker was a partner at a law firm in Bethesda, Maryland.
Ms. Juncker has published numerous articles on a variety of LGBTQ issues, DEI and cultural concerns, as well as Family Law. She participates in marriage, transgender and family law seminars, support groups and panels.
Ms. Juncker has been recognized in “Top Lawyers” in Washington magazine for 2020 and 2021; “Influential Women of Law,” Virginia Lawyers Weekly in 2020; “Top 100 Lawyer,” The National Advocates in 2016; “25 Best Divorce Lawyers in Montgomery County,” Bethesda Magazine, in 2013 and 2017; “Best LGBT Lawyers Under 40,” by the National LGBT Bar Association in 2011; and Virginia Super Lawyers “Rising Star” in 2008.
Ms. Juncker is licensed to practice in Maryland, the District of Columbia, Virginia, and the United States Supreme Court.
She received her B.A. from the University of Virginia in 1996 and her J.D., cum laude, from the George Mason University School of Law in 1999.
