Difficult employees pose problems for businesses of all shapes and sizes. Troublesome team members can hurt workforce morale and interfere with company culture, leading to increased turnover and associated expense. Certain difficult behaviors can also expose companies to legal claims. How a business responds—or fails to respond—to difficult employee situations can also have liability ramifications. This seminar discusses a variety of difficult and problematic employee behaviors and will provide an overview of associated legal risks. The session also focuses on practical guidance and advice addressing how to handle difficult employees in an effective and legally compliant manner.

Andy Sherrod leads Hirschler’s employment law practice group and devotes his practice to helping clients navigate complex employment and business issues. Companies and their executives rely upon his practical advice and sound judgment based on his deep knowledge of employment laws and years of experience resolving disputes both in and out of the courtroom. He begins with his clients’ ultimate goal in mind and crafts effective and efficient strategies to help them get there.
Mr. Sherrod serves as a trusted advisor to businesses owners, executives, and in-house counsel on a wide range of employment law matters, such as drafting executive employment agreements, protecting trade secrets and confidential business information, maintaining compliance with federal and state employment laws, creating effective employment policies, implementing appropriate hiring and firing procedures, conducting wage and hour audits, addressing employment issues in the due diligence process for mergers and acquisitions, advising on OSHA recordkeeping and reporting requirements, and assisting with complaint investigations and EEOC charges. He also trains employees and managers on HR compliance and best practices.
When disputes must be resolved in court, Mr. Sherrod draws upon his first-chair experience in jury trials, bench trials, arbitrations, and appeals to advocate for his clients. He has handled cases in state and federal courts across the country, including many in the “Rocket Docket” of the United States District Court for the Eastern District of Virginia.
Mr. Sherrod has helped businesses resolve a variety of employment cases, including disputes involving discrimination and harassment under federal and state employment laws, wrongful discharge, wage and hour issues, employment agreements, and employee benefits under ERISA. A particular area of emphasis in his employment litigation practice is representing companies and executives in disputes regarding restrictive covenants, including non-competition agreements, non-solicitation agreements, and confidentiality agreements. In his business litigation practice, Mr. Sherrod represents companies and individuals in disputes involving contracts, fraud, business interference, securities, and corporate governance matters (e.g., fiduciary duty claims and business dissolution).
Prior to joining Hirschler, Mr. Sherrod practiced with a large international law firm and served as law clerk to the Honorable Norman K. Moon of the U.S. District Court for the Western District of Virginia.
Jaime B. Wisegarver, Hirschler / Richmond
An experienced legal and business advisor, Jaime Wisegarver assists clients with complex business and employment litigation involving wage and hour laws, restrictive covenants, discrimination, and employment policies and agreements. She also works collaboratively with business owners and management to develop and implement policies, to investigate employee complaints, to ensure proper pay practices, and to draft and enforce employment contracts. In 2022, she was selected as a “Go To Lawyer” in employment law by Virginia Lawyers Weekly.
In addition to her employment focus, Ms. Wisegarver handles a variety of civil litigation matters, with a particular emphasis on cases arising out of real property disputes, including appeals of zoning and other land use decisions, tax assessment appeals, and construction litigation. She has experience in both state and federal courts, as well as in alternative dispute resolution. Her work in multiple practice areas enables her to formulate comprehensive legal and business strategies that not only achieve great results in the courtroom, but also allow her to assist clients in mitigating potential disputes.
Ms. Wisegarver earned her undergraduate degree from the University of Virginia and her law degree, cum laude, from the University of Richmond School of Law, where she received the prestigious Charles T. Norman Award for Outstanding Graduate. She has been recognized for civil litigation among Virginia Business’ “Legal Elite” (2018, 2020); Virginia Super Lawyers (2018-2021); and Best Lawyers in America (2022).
A frequent author and speaker, Ms. Wisegarver also produces “Couch Counsel,” a regular Hirschler video series covering the topics keeping employers up at night. In January 2021, she was a panelist for Virginia Lawyers Weekly’s presentation on the current state of noncompete law in Virginia. She routinely presents to various industry and government groups regarding various employment law matters.
Ms. Wisegarver is admitted in Virginia, West Virginia, the U.S. District Court for the Eastern and Western Districts of Virginia; the U.S. Bankruptcy Court for the Eastern District of Virginia; the U.S. District Courts for the Northern and Southern Districts of West Virginia; and the U.S. Court of Appeals for the Fourth Circuit.
