Understanding how to account for these items via coverture fractions and/or inclusion in gross income and financial resources computations can be a challenge for even the most seasoned practitioner. Do not miss this course, which provides a detailed analysis of how to avoid common mistakes.
Family Law Mediation: Improving Outcomes
Hon. Dennis J. Smith (Ret.), Brian M. Hirsch, Natalie Goldberg, with Nanda E. Davis moderating
Family law mediation is only gaining in popularity throughout the Commonwealth in helping parties resolve conflicts. This presentation focuses on how proper preparation by the mediator, lawyers, and clients can result in more satisfying outcomes and less stress for everyone involved. It covers best practices during the pre-mediation phase, while in session, and in post-mediation follow-up. It also explores techniques for navigating through impasses. A short lecture is given by a judge-mediator, a lawyer-mediator, and a child specialist. This is followed by a panel discussion.
Asserting and Overcoming Privilege in Family Law Matters
Lawrence P. Vance
This session explores what the family law practitioner needs to know about common privileges, such as spousal, therapist-patient, and doctor-patient privileges, and the privilege against self-incrimination. Gain a better understanding of how to assert privileges, how privileges are waived, and the potential consequences for asserting a privilege. There is also a discussion about what you need to know before subpoenaing a witness whose testimony might be privileged, and how you might overcome a claim of privilege by the other side.
You’re Fired! Ethical Considerations in Attorney-Client Relationship Terminations
Barry J. Waldman, Bruce H. Russell, II
A discussion of ethical duties when a client terminates the attorney’s services before the conclusion of the matter, as well as considerations of how, when, and the ethics of the attorney terminating the relationship before the conclusion of the client matter.
